Can Mention Me still send data to Mailjet and AWS when the UK leaves the EU?

Yes, the Governmental Department for Digital, Culture and Sport issued guidelines to UK businesses stating that if the UK leaves the EU without an agreement on future arrangements for data protection, there would be no immediate change in the UK’s own data protection standards. 

The Data Protection Act 2018 would remain in place and the EU Withdrawal Act would incorporate the GDPR into UK law to sit alongside, so Mention Me would still be able to send personal data from the UK to its processors based in the EU. 

I am a client based in the EU, can I still send data to you/ can you still process my data under our existing client agreement?

The legal framework governing transfers of personal data from organisations (or subsidiaries) established in the EU to organisations established in the UK would change on exit in a Brexit ‘no deal’ scenario. 

If the UK is found to have an inadequate level of privacy protection in line with GDPR when leaving the EU, Mention Me can enter into a set of EU model clauses with affected clients. These EU model clauses are treated as an appropriate safeguard for companies to follow to ensure data processing has an adequate level of privacy protection. 

If you’d like to enter into a set of EU model clauses (controller to processor), our Data Protection Officer can send you a document to e-sign.

I am a client based in the UK, can I still send data to you/ can you still process my data under our existing client agreement?

Yes, Mention Me is based in the UK and its core platform is supported by two main providers, both based in Europe. The UK government has confirmed that transfers of data to these European providers will remain compliant with privacy law in the UK. 

Information on Brexit for EU-Based Clients

We’ve had a number of questions from clients asking how Mention Me will be impacted by the UK leaving the European Union without a trade deal. At this stage of the Brexit discussion, we don’t anticipate Brexit having a material adverse impact on our ability to provide clients with a great service.

Mention Me is based in the UK and its core platform is supported by two main providers, both based in Europe. We’ll enter into the appropriate EU (controller-processor) model clauses with clients as necessary.
